All services supplied by Local Event Medics (UK) Ltd. are subject to contract. The contract is
composed of the following terms and conditions, together with the applicable schedule for your
event.
Definitions:
The parties to this agreement are: Local Event Medics (UK) Ltd. (hereinafter known as ‘the company’) And Yoursleves (hereinafter referred to as the client)
‘Venue’ shall mean the premises or location at which the event is held.
‘Operators’ shall mean staff or agents engaged by the company to fulfil the contract,
- Non-Fulfilment: The Company shall not be held responsible for the non-fulfilment of this contract for the reasons beyond its reasonable control. This includes mechanical breakdown, unforeseeable equipment failure, power failure at the venue, sudden illness, and ‘force majeure’ (including but not limited to; extreme weather, flood, terrorism, fire and lighting strike).
- Liability: The Company’s maximum liability under the contract shall be limited to the value of the contract, unless related to negligence in the medical care or actions of the staff members.
- Public Liability Insurance: The Company carries public liability insurance, and all equipment used carries relevant safety standards and certification. Copies of relevant certificates areavailable on request.
- Where an NHS ambulance is called to site, it may be necessary for a HCPC Registered Paramedic (if provided) to travel with the patient if the receiving crew is not trained to the same standard as the paramedic. This will be at the discretion of the onsite paramedic and event medical manager.
- The Company will always endeavour to have staff attend no less than 10 minutes prior to the given start time.
- The Company cannot be held financially responsible for any event cancelled for any reason irrelevant of involvement.
- Any concern or complaint must be raised with the company within 5 working days of the end of your event or as soon as is reasonably practicable afterwards.
- The company will provide all equipment and medical consumables necessary to carry out the level of service booked.
- Please ensure staff on site can obtain fresh, clean water as necessary.
- The company reserve the right to withdraw services but to levy full charges where adequate facilities are not available to enable us to carry out our duties or where the welfare or safety of our staff is at risk.
- Payment: Payment will be due following the submission of an invoice including any supplied Purchase Order numbers.
- Invoices are due 14 days after issue.
- Accounts not settled within required date will be subject to interest charges as allowed in law. This will be worked out as statutory interest as allowed in law. 8% plus than Bank of England base rate added on per day. Any invoice not paid within 30 days of going overdue will be passed to MoneyClaim Online & HMRC.
- Where payment is made by cheque and is not honoured by the bank immediate payment of the account must be made by BACS.
- Payment by cheque is not accepted without prior written permission from The Company.
- A Deposit maybe requested by the company at their discretion. This will be done in writing at the time of booking.
- If the deposit (16) is not paid within the required time, the contract shall be deemed cancelled and no services will be provided and the client shall not claim for any costs, damages, compensation or other recompense.
- Cancellation: Cancellation of this contract will only be accepted by Local Event Medics (UK) Ltd if notice is given by Yourself in writing. Where cancellation is received by Local Event Medics (UK) Ltd payment as percentage of the fee is required as outlined below of the total contract value.
Less than 7 Days = 100%,
7- 10 Days = 50%,
10-15 Days = 33%,
15-30 days = 25%,
More than 30 days = no charge
- Constant vehicle access is required throughout the event to and from the site for the Company vehicles. Which vehicles are permitted access is at the Company’s discretion and may include response or support cars as well as ambulances and medical support.
- Where an event license is not permitted or withdrawn by licensing authorities, or the event is cancelled or postponed for whatever reason, cancellation fees will apply as (18) above.
- Operators remain under the control of the Company, not the event organiser and final decision rests with the Company.
- We must always retain medical control – we will liaise with event and safety organisers, but control of medical staff rests with us.
- We may send greater resources than booked at our cost – whether staff or vehicles – you will only be invoiced for those you have booked.
- The price quoted is for covering during the stated times above. Additional charges will apply where you require us to stay later or arrive earlier.
- Where an event ends earlier than booked, the agreed event charges remains payable in full.
- Where an event operates after dusk, the client is to provide lighting. Heating should be provided in all medical areas when the temperature drops below 18 Celsius.
- The event cover start time is the time at which we will be on site- if you require us to be on site earlier due to restricting vehicle movements or road closures, additional charges will apply pro-rata as per declared rates.
- Should parking not be provided for staff then we reserve the right to add the Parking charge to the final invoice.
- If the event or any part of it takes place within a Congestion Charge, Low Emissions, Ultra Low Emissions or any form of clean air Zone we reserve the right to add the charges for this to the final invoice for any staff vehicle which has to make the payment.
